TERMS AND CONDITIONS

The following Terms and Conditions (“Terms”) govern the promotion (the “Promotion”) discussed in the SMS message, FashionNova app-push marketing, and FashionNova website banner sent and/or posted by Fashion Nova, LLC (“Fashion Nova”) to select U.S. customers who are 18 years of age or older at the time of participation on November 29, 2024 (the “Promotion Date”). Employees of Fashion Nova, participating vendors (if any) their respective parent companies, affiliates, and subsidiaries, and their respective participating advertising, promotions, and public relations agencies as well as members of their families and/or those living in the same household as such individuals are not eligible to participate. You must have access to the Internet and a valid email address in order to participate. By participating in the Promotion, you accept and agree to be bound by these Terms, in addition to Fashion Nova’s Privacy Policy, available here, and General Terms of Service, available here.

$1,500 for First 100: Beginning at 5:15 pm Pacific Time (“PT”) on the Promotion Date, the first 100 U.S. customers (each, a “Recipient”) who buy merchandise on FashionNova.com or the FashionNova app (the “Site”) will each receive $1,500.00 via ACH deposit, PayPal, or check by mail (each, a “Payment”). Limit one Payment per customer and/or account. While supplies last; Fashion Nova’s clock is the official clock, and the first 100 orders will be selected in the order they are received by Fashion Nova. Recipients will be notified within three (3) business days of the Promotion Date via the email address used to place the qualifying order and must sign and return a publicity/liability waiver within 24 hours of prize notification. Recipients will be required to complete and return an IRS W-9 form (i.e. Request for Taxpayer Identification Number and Certification) and provide necessary information for payment options selected within five (5) business days. Failure to timely return the waiver, IRS W-9 form, or any other documentation requested by Fashion Nova may result in disqualification. Taxes on Payments are the sole responsibility of Recipients. Customer understands and acknowledges that before receiving and as a condition of accepting the Payment, Fashion Nova may require that customer appear in or post social media content discussing the Promotion and/or acceptance of the Payment, including but not limited to a testimonial video. Customer further agrees that if Fashion Nova contacts customer by phone, customer consents to Fashion Nova’s audio recording of that call and to publicize such audio recording in any and all media now known or hereafter developed, for trade, advertising, public relations and promotional purposes without any further compensation, to the extent legally permitted.

50% off Sitewide: Customers will receive 50% off the listed prices for all merchandise purchased from the Site. No code needed; the discount will be applied automatically at check-out. The discount will not be applied to shipping, gift cards, or sales tax. No adjustment on previously placed orders.

Additional Terms: Fashion Nova reserves the right, in its sole discretion and without providing prior notice, to modify or terminate the Promotion. Qualifying purchases must be made for personal use and not for resale; Fashion Nova may disqualify and/or cancel orders placed by anyone who it believes is purchasing for resale. The Promotion is provided on an “as is” basis without any representation or warranty of any kind. To the fullest extent permitted by law, Fashion Nova shall not be liable for any loss or damage whatsoever caused by matters relating to the Promotion including, but not limited to, financial, human, machine, or typographic error. Fashion Nova reserves the right, in its sole discretion, to disqualify customers from the Promotion if there is reasonable belief that there has been an attempt to obtain or generate any fraudulent or other non-permissible mechanisms to participate in the Promotion.
