TERMS AND CONDITIONS

The following Terms and Conditions (“Terms”) govern the promotion (the “Promotion”) discussed in the SMS message sent by Fashion Nova, LLC (“Fashion Nova”) to select customers on December 1, 2024 (the “Promotion Date”):

The first 2500 customers who buy merchandise on FashionNova.com (the “Site”) on the Promotion Date, beginning at 3:30 pm PST, will be issued a promotional merchandise credit voucher for $50.00 of merchandise credit for use at fashionnova.com (“Shopping Credit”). Shopping Credit will expire on January 31, 2025.  Limit one Shopping Credit per customer and/or account. Shopping Credit may only be used for personal use and not for resale and may not be used at any Fashion Nova retail store (online only at FashionNova.com). Shopping Credits will be emailed within 3 business days of a customer’s purchase confirmation, and will be sent to the email provided at check out. While supplies last—only the first 2,500 orders placed after 3:30 pm PST will receive Shopping Credits. Fashion Nova’s clock is the official clock, and the first 2,500 orders will be selected in the order they are received by Fashion Nova. Customer understands and acknowledges that before receiving and as a condition of accepting the Shopping Credit, Fashion Nova may require that customer appear in or post social media content discussing the Promotion, including but not limited to a testimonial video. Customer further agrees that if Fashion Nova contacts customer by phone, customer consents to Fashion Nova’s audio recording of that call and to publicize such audio recording in any and all media now known or hereafter developed, for trade, advertising, public relations and promotional purposes without any further compensation, to the extent legally permitted.

Fashion Nova reserves the right, in its sole discretion and without providing prior notice, to modify or terminate the Promotion at any time. Employees of Fashion Nova, its subsidiaries, and affiliates and their respective directors, officers, agents, representatives, members of their immediate families, and persons with whom any of the foregoing are domiciled are not eligible to participate in the Promotion.

The Promotion is not valid for resale or for commercial or reseller accounts. Fashion Nova reserves the right to refuse the offer to anyone who may be purchasing for resale. The Promotion is provided on an “as is” basis without any representation or warranty of any kind. To the fullest extent permitted by law, Fashion Nova shall not be liable for any loss or damage whatsoever caused by matters relating to the Promotion including, but not limited to, financial, human, machine, or typographic error. Fashion Nova reserves the right, in its sole discretion, to disqualify customers from the Promotion if there is reasonable belief that there has been an attempt to obtain or generate any fraudulent or other non-permissible mechanisms to participate in the Promotion. By participating in the Promotion, you accept and agree to be bound by these Terms, in addition to Fashion Nova’s Privacy Policy, available at https://www.fashionnova.com/pages/privacy-policy, and Fashion Nova’s Terms of Service, available at https://www.fashionnova.com/pages/terms-of-service. The Promotion is and the agreed upon Terms set forth herein shall be governed by the laws of the State of California, excluding conflicts of laws principles. The federal and state courts in Los Angeles, California shall have exclusive jurisdiction over any disputes arising from the Promotion.
